Medical Marijuana Law took effect in 2001, allowing physicians to recommend the use of marijuana for medical use by patients with qualifying chronic or debilitating conditions. The law provides protection in using or cultivating marijuana in an allowable amount.

Caregiver Laws

A caregiver must be at least 18 years of age, have significant responsibility in managing the health and well-being of a qualifying patient, and assist or cultivate marijuana for medicinal use. A caregiver must have a valid card registered under the Department of Health and Human Service and have no background of any drug felony conviction. A caregiver cannot be the patient’s physician and must only allowed to possess, produce, or deliver a total of twelve plants or two-and-a-half ounces of marijuana in a single fourteen-day period.

Dispensary Laws

In counties with 100,000 people or more, there shall no be more than one medical marijuana dispensary registered on a patient’s card. Registered patients may only purchase from one medical marijuana dispensary at a time. No one shall ever use marijuana or Marijuana-Infused Products (MIP) inside a dispensary. A medical marijuana dispensary must be registered with complete required documents, information, and required fee under the Department of Health and Human Service. Anyone under 18 years of age is not allowed to enter the dispensary.Location must be at least 1,000 feet from a private and public school and must provide the required security equipment to protect facility from unwanted entrance.

Grower Laws

A registered patient, the patient’s designated caregiver, and a registered dispensary can be a grower. A grower must present a valid registration card under the Department of Health and Human Service to legally grow or cultivate marijuana for medical use. Must be at least 18 years and above with no past drug felony offense. A grower can possess a total of twelve plants and no more than two-and-a-half ounces of marijuana in a single fourteen-day period. Marijuana and plants must be stored in an enclosed, locked facility and sited at least 1,000 feet from a private and public school.
